ART OF USMLE LLC – REGISTRATION TERMS AND CONDITIONS
Please carefully read these terms and conditions (“Terms and Conditions”) before registering for any courses using this website (the “Art of USMLE Site”). By registering for course work on the Art of USMLE Site, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use the Art of USMLE Site or register for any courses.
You agree to the following:
Payment. You will pay all tuition and fees when due to Art of USMLE. Your eligibility to register for and take any course offered by Art of USMLE is expressly conditioned upon your agreement to pay all fees and tuition when due. Payment for any course is due not later than two weeks prior to the start for the course.
License. All Art of USMLE course materials, in any form and whether provided in hard copy or through the Art of USMLE Site, consist of material that is either owned or licensed by Art of USMLE. Art of USMLE grants you a worldwide, non-exclusive, and non-transferable license to use course materials solely for your personal, non-commercial use. Course material may not be transferred, shared with or disseminated with anyone for any purpose other than the exam preparation programs and courses that are offered by the Art of USMLE.
Cancellation. Cancellation of your registration requires at least three business days’ advance written notice to Art of USMLE. If you cancel without at least three business days’ notice, you will forfeit your tuition payment.
Clinical Skills Money Back Guarantee. For the five day Clinical Skills course only, Art of USMLE offers a 100% money-back guarantee and will refund tuition payments to students who do not receive a passing grade on the Step 2 CS examination. In order to be eligible for the guarantee, students must (a) attend all sessions of the course during each of the five days it is taught; (b) follow all Art of USMLE guidelines; (c) maintain contact with their Art of USMLE instructor as directed and submit patient notes through the day of the exam. Students who decide to forego taking the USMLE Step 2 CS examination, for any reason whatsoever, will not be eligible for a refund. In the event of extraordinary circumstances experienced by a student that affect the student’s ability to pass the exam, Art of USMLE in its discretion may offer make-up courses in lieu of a refund. A student seeking a tuition refund in connection with the guarantee shall inform Art of USMLE of an exam failure, and provide documentation, within fourteen (14) days.
Exclusion of Warranties. Except as expressly provided herein, Art of USMLE does not offer a warranty or guarantee of any kind.
Dispute Resolution. These Terms and Conditions will be interpreted under the law of the state of Illinois. Further, any claim or cause of action related to your relationship with Art of USMLE, your course work or these Terms and Conditions shall be brought exclusively in the state or federal courts located in Chicago, Cook County, Illinois, and you agree to submit to the exclusive personal jurisdiction of such courts and hereby appoint the Secretary of State of Illinois as your agent for service of process. You agree to waive any objection that the state or federal courts of Cook County, Illinois, are an inconvenient forum.
Limitation of Liability. IN NO EVENT SHALL ART OF USMLE OR ITS EMPLOYEES, AGENTS, LICENSORS OR CONTRACTORS BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR MULTIPLE DAMAGES OF ANY KIND.
Limitation of Claims. Any action on any claim against Art of USMLE must be brought by the user within one (1) year following the date the claim first accrued, or shall be deemed waived.
USMLE and other trademarks are the exclusive property of the respective trademark holders and are not affiliated with The Art of USMLE, LLC or this website.
